CAT Hyderabad Orders on Sr. Postmaster Examination
Hon'ble CAT, Hyderabad Bench allowed OA No.1316/2011 and directed the CPMG, AP Circle, Hyderabad to take the list of willing and eligible ASPs from the Association and allow them to appear in Sr. PM Examination scheduled to be held on 31.12.2011.
Complete Order dated 21.12.2011. is furnished below :-
1. MA is allowed. Registry is directed to register the OA.
2. Admit.
3. Notice.
4. As in original notification/rules, there is no prohibition for the ASPs from appearing for the examination it is directed that all the eligible ASPs shall be allowed to appear for the examination and their answer sheets shall be kept in a sealed cover without publishing their results until further orders.
5. The first applicant shall furnish a list of all eligible candidates to the 2nd respondent before 5.00 P.M. on 23.12.2011.
6. Post the matter on 19.01.2012 for filing counter.

Sir / Madam,
The undersigned is directed to say that there are lot of audit paras raised by teams of DG P&T Audit in many circles regarding irregular commission paid to SAS agents where the investment was made exceeding the limit of Rs.50,000/- by cash at a time. One Draft Audit Para relating to Delhi and NE Circles has become CAG Para.
2. As per agency rules, prior to issue of SB Order No.3/2011 dated 11.3.2011, limit for acceptance of cash at a time from SAS agents was Rs.50,000/- which has now been reduced to Rs.10,000/-. In 2004, Regional Director, National Savings Institute, New Delhi vide letter no. Misc/2004 dated 3.11.2001 had intimated the Delhi Circle that agents are not entitled for commission on cash deposits of more than Rs., 50,000/- at a time. CAG Para was also referred to Min. of Finance (DEA) which opined that commission if paid in such cases is irregular and recovery of commission paid cannot be waived.
3. It is therefore requested that where any SAS agent deposited cash more than Rs.50,000/- at a time in any post office and commission was paid to him, the commission paid has to be recovered from the concerned agent if his agency is active and action should be taken against the officials responsible for accepting cash deposits exceeding the prescribed limit. Where the agent is inactive but his agency is not lapsed, his appointing authority may be asked to recover the amount from his security deposit. In case the agency of agent is expired and not further renewed or agent has already expired, such cases may be referred to this office.
4. In future, it may be ensured that no cash more than the prescribed limit of Rs.10,000/- at a time should be accepted from the SAS agents as no commission is payable on such irregular deposits.
5. It is requested that necessary action may be taken immediately to circulate this letter to field units and any violation of these orders by postal staff should be viewed seriously.
6. This issues with the approval of DDG(FS).

Income Tax exemption limit for Children Education Allowance should be revised
National Federation of Indian Railwaymen(NFIR) General Secretary Mr.M.Raghavaiah has expressed his views in a letter on 1st September, 2011 to the Hon’ble Finance Minister regarding the exemption limit for Children Education Allowance under Income Tax Act.
He explained that the present exemption limit for Children Education Allowance (CEA) under section 10 (14) of the Income Tax Act is Rs.I00 per month per child. This limit as fixed more than 2 decades back when the maximum amount of Children Education AIlowance for Central Government Employees was fixed at Rs. 100/- per month per child under the IVth Central Pay Commission. Now the current rate of this allowance is Rs.1000 per child.
He further stated that the Federation feels that this can never be the intention of the Government as education and developing knowledge of youth is top priority matter for the country. The distortion has taken place due to non—revision of the exemption limit for payment of income tax.
Finally, NFIR requests the Hon’ble Finance Minister to kindly consider and grant enhancement of exemption limit as suggested above and make it effective from the financial year 2011—12.

Enhancement of Income Tax exemption limit for Transport Allowance in the case of Central Government Employees.

He also noted that the exemption limit prescribed in 1997 has been continuing at the same level till date. Over this long period of 14 years, the cost of transport has increased manifold and recognizing this fact the Central Government has itself enhanced the allowance upto Rs.3200 to its employees.
He suggested that the exemption limit may be raised to the level of transport allowance admissible to Central Government employees as was done in the year 1997 as a policy.

The undersigned in directed to say that the period of probation to be prescribed for different posts/services in Central Government have been laid down in this Department’s 0M. No. F 44/1/59-Ests(A) dated 15.4 1959 as amended from time to time. With a view to prevent Government servants from becoming possible victims of arbitrary actions or inordinate delay in considering completion of probation/confirmation, the existing instructions on provisions regarding probation in the service recruitment rules relating to Central Civil Services and Posts have been reviewed. It is proposed that in the service / recruitment rules for all Central Civil Services and Posts, in addition to the period of probation, wherever prescribed, corresponding provisions as envisaged in the draft guidelines enclosed herewith, may be incorporated in consultation with this Department.
2.Before the guidelines in the draft O.M. is finalized, all Cadre Controlling Authorities are requested to offer their comments/views in this regard, if any. by 8.10.2011 to the undersigned or by e-mail at dse@nic.in

The undersigned in directed to say that the period of probation to be prescribed for different posts/services in Central Government have been laid down in this Department’s O M No.F 44/1/59-Ests(A) dated 15.4 1959 as amended from time to time. Although instructions exist to the effect that save for exceptional reasons probation should not be extended for more than a year and no employee should be kept on probation for more than double the normal period apart from instructions for timely action on completion of probation/confirmation, these are not invariably followed.
2. With a view to prevent Government servants from becoming possible victims of arbitrary actions or inordinate delay in considering completion of probation/confirmation, the existing instructions on provisions regarding probation in the service/recruitment rules relating to Central Civil Services and Posts have been reviewed, lt has now been decided that:
(i) 1f during the period of probation, a probationer has not undergone the requisite training course or passed the requisite departmental examinations.if any prescribed, or has not been on duty/training for at least 75% of the probation period the period of probation may be extended by such period or periods as may be necessary subject to the condition that the total period of probation does not exceed double the prescribed period of probation except in the cases mentioned in (ii) below:
(ii) the period of probation may be extended for such period as the Central Government may think fit in the circumstances of the case in respect of a probationer who is:
(a) under suspension
(b) against whom disciplinary proceedings are pending: or
(c) against whom prosecution for criminal charge is pending
(iii) Where a probationer who has completed the period of probation to the satisfaction of the Central Government is required to be confirmed, he shall be confirmed in the Services/Post at the end of his period of probation, having been completed satisfactorily. In such cases, where no order extending the probation period has been issued and no order of confirmation is issued within one year of completion of the prescribed period of probation, the probationer would be deemed to be confirmed in the service/post.
3. In the Service/Recruitment Rules for all Central Civil Services and Posts, in addition to the period of probation. wherever prescribed, corresponding provisions, as in para 2 above, may be incorporated in consultation with this Department in the light of the above instructions.

Govt officials may be allowed to use Facebook Ahmedabad, September 9
The government is planning to put in place a framework for officials that would allow them to leverage the power of the social media, a top official of the Department of Information and Technology (DIT) said here today.
“We are creating a framework that would help Central departments and officials to use social media like Facebook, Twitter effectively,” said Additional Secretary DIT, Shankar Aggarwal.
“We expect to give a final shape to it (framework) over the next two or three months and notify it,” he said.
“The idea is that they can enter into a dialogue with the public more freely, take suggestions, feedbacks and provide updates. It shall be more of a two-way rather than a one-way communication,” Aggarwal stated.
“Social media is being used extensively by civil society, but unfortunately, we do not have any framework for the Central government and state government,” he said.
“The government officials are scared of using the social media because they are not sure whether they are allowed to use it or not,” he added.
Meanwhile, the government is planning to introduce the Right to Public Services Act soon that would make it mandatory for the government entities to deliver public services in an electronic form too.
“We have already created a framework and for this (Act) and the framework is to be converted into a law. We think we will be able to introduce it in the next session of the Parliament and this will become a law,” he said.
“Under this, we shall be trying to ask the government entities to deliver all the public services in an electronic form also. It has to be achieved over the next five years,” he informed.
Aggarwal said they had been planning to develop a payment gateway for the entire country so that the people could pay electronically for various services. — PTI

AMENDMENT IN ANTI-CORRUPTION ACT, 1988
The property of corrupt public servant is confiscated under the provisions of Criminal Law (Amendment) Ordinance, 1944 and Prevention of Money Laundering Act, 2002. However, to make the Prevention of Corruption Act, 1988 self contained and comprehensive the Government is considering incorporating the provisions for confiscation/forfeiture of property of corrupt public servants in the Prevention of Corruption Act, 1988.
On 8th June, 2011, the media had reported that the Hon'ble Supreme Court has sought amendment to the Prevention of Corruption Act, 1988. These observations were reportedly made by the Supreme Court while dismissing an appeal filed by an Assistant Commissioner, Central Excise, against his conviction. However, the formal order passed by the Hon'ble Supreme Court on 8.6.2011 in the case, i.e. Criminal Appeal No. 945 of 2006 (Sat Paul vs. State of West Bengal & Anr.) does not contain any such observations.
A Committee headed by the Chairman, CBDT has been constituted to examine ways to strengthen laws to curb generation of black money in India, its illegal transfer abroad and its recovery. The Committee shall examine the existing legal and administrative framework to deal with the menace of generation of black money through illegal means including inter-alia (i) declaring wealth generated illegally as national asset; (ii) enacting/amending laws to confiscate and recover such assets; and (iii) providing for exemplary punishment against its perpetrators. The Committee is required to consult all stakeholders and submit its report within a period of six months.
As per information provided by the CBI, it has not unearthed any case wherein benami properties of more than Rs.100 Crore have been unearthed against any officer in any case.
This information was given by Minister of State in the Ministry of Personnel, Public Grievances and Pensions and the Prime Minister's Office, Shri V. Naraynasamy in written reply to a question in the Lok Sabha today.

The issues raised in the charter of demands were considered by the Committee and a gist of discussions thereof is as follows:
i. The Association was apprised that the proposal to revise the Grade Pay of Inspector Posts from Rs.4200 to Rs. 4600 did not find favour with the Ministry of Finance on the ground that there can not be two levels in the same hierarchy i.e., IPOs & ASPOs, drawing the same grade pay. They were further informed that the proposal could be considered only if IPO & ASPOs cadres are merged into one cadre and the gazetted status of ASPOs is foregone. The Association agreed to submit a revised proposal to be considered by the Department.
ii. A committee will be constituted to look into promotional prospects of the IPOs/ASPOs. Action -SR
iii & iv It was explained to the Association how the introduction of Postmaster’s cadre has not , in any way, adversely affected their overall promotional prospects. The Association was also told of the need to encourage meritorious candidates by bringing them on fast track promotion, which will provide stability to the PS Group B/Time Scale Cadres.
v. Supply of laptops to IPOs/ASPOs will be examined. Action – Tech. Div.
vi. The Association was explained that the post of HSG-I was not a promotional post for IPOs and further HSG-I post is non gazetted whereas the post of ASPOs is gazetted . In the background of the above, the proposal could not be considered.
vii. The matter of revision of rate of remuneration for performing duty as invigilators in the Departmental examinations is under process. Action – DDG (Rectt. & Pett.)
viii. The staff side was explained that the proposal regarding promotion earned through examination not to be considered while granting MACP was not in line with this scheme and therefore could not be considered.
ix. The demand of the staff side to hold periodical meeting at regular intervals was accepted. Action – SR
The meeting ended with a vote of thanks to the Chair.
All the CHQ Office bearers / Circle Secretaries / Members of the Association are requested to kindly go through the minutes and offer their views to the CHQ through Email / letter so that further action could be taken by the CHQ in the larger interest of the Inspector, Posts cadre.

Modernisation of Department of Posts
Government has approved the ‘IT MODERNIZATION PROJECT’ of Department of Posts for computerization of Post Offices, Mail Offices, Administrative Offices and other field offices. This will involve establishment of required IT infrastructure, development of required software applications with an outlay of Rs.1877.2 crore.
The project has the following salient features:
• It will establish IT infrastructure of Data Centre and Disaster Recovery Centre and networking of all Departmental Post Offices including appropriate connectivity in the Branch Post Offices in the rural area.
• The project envisages development of integrated modular scalable applications for Mail, kBanking, Postal Life Insurance, solutions for Accounts and HR operations of the department.
• The rural post offices will be provided with rural ICT devices with required applications for performing Postal, Savings Bank, Insurance, MGNREGS and Money Order operations.
• Provision has been made for training, change management, capacity building of the employees of the department along with Project Management activity for smooth and timely implementation of the project.
It is planned to network all Departmental Post Offices and Branch Post Offices in the country subject to availability of connectivity and resources under the “India Post Technology Project-2012”.
The departmental Post Offices are proposed to be networked with appropriate connectivity. Branch Post Offices located in rural areas are proposed to be networked using available connectivity at these locations. The rural ICT Devices in the Branch Post Offices will have the capacity to work in both online/offline mode. The IT project is expected to be implemented by 2012-13 subject to the availability of funds.
This information was given by Shri Sachin Pilot, the Minister of State for Communications and Information Technology in written reply to a question in Lok Sabha today.

Meeting with the Secretary (Posts) on 11-08-2011
Today, the Secretary (Posts) took meeting with our Association at 15:00 Hrs. I alongwith Shri Dinesh Khare, President, Shri Ajit Kumar, C.S. Kerala and Shri Rajdeo Prasad, C.S.Bihar attended the meeting. All items included in our Charter of Demands were discussed in detail. View of the Secretary (Posts) was positive towards our demands.
Official minutes of the meeting will be published on the blog on the receipt of the same from the Department. The Secretary (Posts) informed that upgradation of Grade Pay of IP from Rs.4200 to Rs.4600 will be only possible after merger of the post of IP and ASP. The Secretary (Posts) also assured us that a committee will be constituted for restructuring of IP cadre. The Secretary (Posts) agreed to examine the issue of supply of Laptop to all IPs / ASPs other than Sub Divisional Heads.
She directed the DDG(P) / Director(SPN) to discuss the issue of quota of IP Line in PS Group "B" examination on introduction of Postmaster Cadre in Postal Wing. Accordingly, matter was discussed in the chamber of the DDG(P) but could not be resolved.

Sub: Grant of leave to the staff working under HSG I Postmaster.
Sir / Madam,
It is observed that HSG.I Postmaster is competent to grant only casual leave to the staff working under him/her. The applications for grant of other kind of leave to staff are forwarded by him/her to the Division office for approval. It has been brought to the notice of the Directorate that at times the said procedure takes time and if such officials who donot have casual leave left in their accounts want to proceed on earned leave immediately to some unforeseen circumstances, they face problems in proceeding on leave at short notice.
2. The matter has been looked into. It has been decided by the competent authority in the Directorate that in such pressing circumstances, HSG I Postmasters while recommending earned leave may relieve the official of his duties in anticipation of grant of leave by the competent authority, provided :
I. The earned leave applied for by the individual is not for more than the period of three days.
II. No substitute is required in case the official proceeds on leave.
III. The leave may be recommended by the HSG I Postmaster by recording that it is being recommended subject to the availability of leave in the credit of the applicant.
IV. The official may be relieved after duly following the procedure of handing/taking over of the charge.
V. If later on the sanctioning authority finds that the official does not have the leave applied for to his credit he should obtain the revised application from the individual for the kind of leave he/she is entitled to at the earliest.
VI. If the official needs earned leave for more than three days or wants to extend the earned leave beyond three days he should apply for same well in advance so that it is sanctioned as per the existing procedure.

The Department of Personnel and Training in consultation with NIC has developed a software package for submitting the proposals for framing/amendment of RRs in the on-line process In the first phase, 15 Ministries/Departments had been included and proposals on RRs from these Ministries/Departments are being processed on line before considering them for final approval in the concerned file received physically. A copy of the User Manual on Recruitment Rules Formulation
Amendments Monitoring system (RRFAMS) prepared by the NIC, DOPT is enclosed
2. It is now proposed to extend the software to all the Ministries/Departments for which a Workshop is proposed to be conducted in ISTM during September, 2011 for hands-on experience of the software package. The proposals on framing/amendment of RRs from the Ministries/Departments shall require to be submitted on-line and which shall be examined by this Department on-line. Once it is approved in the on-line system, the files need to be sent along with the printout of the RRs approved for formal approval by this Department.
3. It is requested that the Ministries/Departments may identify the concerned nodal officers (not below the level of Section Officer) who shall be dealing with formulation of Recruitment Rules etc for deputing them to the Workshop alongwith the officers from NIC in the Ministry/Department. The exact dates of the workshop will be intimated soon.

Subject: SCHEME FOR ENGAGEENT OF GDS ON COMPASSIONATE GROUNDS-MERIT POINTS AND PROCEDURE FOR SELECTION – REVISED PROVISIONS THEREOF.
Attention of all concerned is invited to this Directorate letter of even number dated 14 Dec 2010 under which the scheme for engagement of GDS on compassionate grounds with merit points & procedure for selection was circulated and made effective for all the compassionate engagement cases to be considered on or after 01.01.2011
2. The Scheme has recently been reviewed in this Directorate and in partial modification to the existing provisions contained in Para 7 of the Scheme, the following revised provisions may be substituted:-
(a) The existing ceiling of 10% is removed. All requests for compassionate engagement would be considered by the Circle Relaxation Committee on application of the relative merit points prescribed in this Directorate letter dated 14.12. 2010 in hard and deserving cases only subject to availability of the vacancy for the purpose & fulfillment of the terms and conditions of the GDS post. The term "hard and deserving cases" would mean cases over and above 50 merit points.

Attention of all concerned is invited to this Directorate letter of even number dated 14 Dec 2010 under which the scheme for engagement of GDS on compassionate grounds with merit points & procedure for selection was circulated and made effective for all the compassionate engagement cases to be considered on or after 01.01.2011
2. The Scheme has recently been reviewed in this Directorate and in partial modification to the existing provisions contained in Para 7 of the Scheme, the following revised provisions may be substituted:-
(a) The existing ceiling of 10% is removed. All requests for compassionate engagement would be considered by the Circle Relaxation Committee on application of the relative merit points prescribed in this Directorate letter dated 14.12. 2010 in hard and deserving cases only subject to availability of the vacancy for the purpose & fulfillment of the terms and conditions of the GDS post. The term "hard and deserving cases" would mean cases over and above 50 merit points.

The humble post office is all set to undergo a radical change with a proposal to convert over 1.5 lakh post offices across the nation into full fledged banks on the anvil.
Telecom Minister Kapil Sibal wants to reach out to the masses in the rural areas with modern banking facilities through the post offices.
"We want to commercialise the department. We will seek a licence from the RBI to convert all our post offices into banks," Sibal told PTI.
The lack of modern banking facilities in rural areas and dependence of villagers on informal sector for their credit requirements has prompted the government to work on financial inclusion by way of setting up 'postal banks'.
"The State Bank of India can't build branches all over India, but there are post offices across India. The branches are already there, so infrastructure expenditure is not required. So you can actually give banking facilities at relatively lower costs, which would be extremely beneficial to people," he said.
The post offices currently offer financial services like savings bank, postal life insurance, pension payments and money transfer services. Its total corpus stood at Rs 5,82,832.9 crore as on March 31, 2011.
DoP's revenues grew 11 per cent to Rs 6,954.09 crore in 2010-2011 from Rs 6,266.70 crore in the previous fiscal.
However, negative growth rate in some circles has pushed the Department's deficit to Rs 6,625 crore in FY'11, almost equal to the annual revenue of the Department.
"I want to make the (postal) system commercialised. By corporatising over 1.5 lakh post offices across the country, the ministry is expecting to improve the quality of services, increase profitability and reduce prices," Sibal said.
Out of the 22 DoP circles, some circles like Chhattisgarh have reported a negative growth of 19 per cent, Jharkhand 18 per cent and North East 15.9 per cent, whereas Assam (23.7 per cent), Haryana (19.5 per cent), Karnataka (13.5 per cent) and Tamil Nadu (13.9 per cent), recorded positive growth.
Among other steps, the Minister has asked members of Postal Services Board (PSB) to ensure 20 per cent revenue growth on sustainable basis.
Each member of the PSB has been asked to identify, commercialise and operationalise five major schemes of the Indian government, and partner with 5 PSUs and 10 corporate houses for commercial tie-ups with India Post with revenue potential of at least Rs 50 crore each.
DoP is also believed to be working towards setting up ATMs and offer debit cards for its customers.
"My vision is that post offices must become banks, so that an ordinary man can with Rs 10 open an account. We can set-up ATM machines for the e-banking...we can do e-retail," Sibal said.
According to officials, work for setting up 1,000 India Post ATMs is at an advanced stage and DoP has already held parleys with vendors on this front.
The Department is also working on providing skill development courses to its over 4.75 lakh employees with the Human Resources Development Ministry.
"The postman should also learn e-banking so that he can actually help the consumer on the ground. So, we are developing specialised skill development courses with the HRD Ministry," Sibal said.

I am directed to refer to the Department's letter no. 13-1/93-SR dated 25.02.1994 circulating Department of Personnel & Training's OM No. 2/10/80-JCA dated 31.01.1994 regarding procedure for verification of membership of associations for the purpose of recognition under CCS(RSA) Rules, 1993. In accordance with instructions contained in said OM, option, if any, for alteration, withdrawal or inclusion of new members is to be given in the month of April each year to DDO or any other designated authority.
2. The Department, vide letter No. 13/01/2010-SR dated 18.02.2010, modified 'letter of authorization' prescribed by the DOPT specifically in order to comply with the directions of the Hon'ble Court of Madras given in Writ Petitions No. 4704-4707 of 1999 and Contempt Petition No. 950/09. The modified 'letter of authorization' was endorsed with signature of Director (SR & Legal) with an objective to rule out the possibility of using the old forms bearing the signature of the employees, as some of the associations had complained about it.The signature of Director (SR & legal) has no relevance in regard to letters of authorization which may be used for change of option or for seeking new membership in the month of April every year.
3. All the 'letter of authorization' whether bearing Director (SR & Legal)'s signature or not, applied during the month of April may be considered as per the standing instructions and in view of the clarification in the preceding paragraph.

I am directed to state that the issue of organizing frequent meetings/melas on holidays and Sundays, thus depriving the employees of their legitimate right to avail the break was considered in a meeting taken by Secretary to discuss charter of Demands served with the notice of indefinite strike w.e.f. 05.07.2011 by Postal Joint Council of Action.
2. While in certain circumstances it may be unavoidable strategically beneficial for the Department to hold meetings/melas etc on holidays and Sundays, it may not be done so in a routine manner. Needless to say, the weekly break and holidays etc. have their own significance and it may be kept in view while calling the officials for duty during the break.

Respected Madam,
It has come to the notice of the Association that due to delay in induction training for departmental IPs and shortage of Inspectors Posts , some Circles (MP & Orissa) have given them adhoc appointment as Inspector Posts pending induction training.
2. There is no uniformity in the Circles for adhoc appointment as Inspector Posts. The department is already giving appointment to PS Group 'B' officers without induction training at PSCI Ghaziabad. Due to shortage of staff , the department is also giving appointment to direct recruited PAs/SAs without induction training.
3. You are well aware that scheme for allotment of surplus qualified candidates in IP examination was started by the department in the year 2007 due to shortage of manpower in Inspector Posts cadre and the same has since been discontiued vide Dte.O.M. No. A-34020/01/2007-DE dated 21.07.2011.
4. In view of above facts, it is requested to kindly arrange for issue of instructions to all Circles for adhoc appointment of surplus qualified IPs pending induction training due to shortage of manpower in Inspector Posts cadre.

Respected Madam,
It has come to the notice of the Association that due to delay in induction training for departmental IPs and shortage of Inspectors Posts , some Circles (MP & Orissa) have given them adhoc appointment as Inspector Posts pending induction training.
2. There is no uniformity in the Circles for adhoc appointment as Inspector Posts. The department is already giving appointment to PS Group 'B' officers without induction training at PSCI Ghaziabad. Due to shortage of staff , the department is also giving appointment to direct recruited PAs/SAs without induction training.
3. You are well aware that scheme for allotment of surplus qualified candidates in IP examination was started by the department in the year 2007 due to shortage of manpower in Inspector Posts cadre and the same has since been discontiued vide Dte.O.M. No. A-34020/01/2007-DE dated 21.07.2011.
4. In view of above facts, it is requested to kindly arrange for issue of instructions to all Circles for adhoc appointment of surplus qualified IPs pending induction training due to shortage of manpower in Inspector Posts cadre.

Pension can not be withheld due to criminal case: CAT
New Delhi, Jun 7 (PTI) Pension and increments of a public servant cannot be withheld only on the basis a pending criminal case against him unless he is convicted, the apex administrative tribunal has held.
"It is amply clear that only on the basis of the case pending against the applicant (Primary School Head Master Lakhi Ram), pension cannot be withheld under Central Civil Services (CCS Pension) Rules, 1972," a two-member bench of Central Administrative Tribunal headed by Justice Meera Chhibber said.
The bench also favoured releasing gratuity during the pendency of criminal case but with an earlier judgement of the CAT ruling against it, the bench referred the question on the gratuity issue to a larger bench.
"Gratuity cannot be withheld under rules of CCS Pension Rules. Otherwise also as per the provision (of) Payment of Gratuity Act, 1972, gratuity cannot be withheld," it said.
"Since we have taken a different view about release of gratuity during the pendency of criminal case than what had been held by the coordinate bench in another case in 2009, the matter may be placed before the chairman on administrative side for constitution of a larger bench to determine the clear position of law on the subject," the bench said.
The judgement came on a petition filed by Lakhi Ram, a Municipal Corporation of Delhi-run primary school headmaster, who retired in August 2007.
He had been suspended on August 13, 2001 after his arrest in criminal case relating to a property dispute.
Though he was reinstated in May 2005 and retired in 2007, his annual increments were stopped from 2001 and were not restored even after his reinstatement in service.
The court directed Education Department of Municipal Corporation of Delhi to grant increments to him from the date of his reinstatement to his superannuation and to fix his pay as per the sixth pay revision and determine his provisional pension.

Charter of Demands of All India Association of Inspector, Posts & Asstt. Superintendent, Posts
i. Up-gradation of Grade Pay of Inspector, Posts from Rs. 4200/- to Rs. 4600/- and merger of post of Assistant Superintendent, Posts with the post of PS Group “B” as both are having Gazetted status and difference in Grade Pay is only Rs. 200/-
ii. There are 866 posts in PS Group “B” cadre. At present 75% posts i.e., 649 are filled through DPC on the basis of seniority cum fitness. 19% posts i.e., 165 are filled through LDCE among IP line officials and 6% i.e., 52 are filled through LDCE among General Line officials. Consequent upon the introduction of Postmaster cadre, there should be no change in 75% posts i.e., 649 posts through seniority quota. 87 posts of Senior Postmaster to be filled up through LDCE of IP line officials should be adjusted in 165 posts of existing examination quota of PS Group “B”.
iii. Consequent upon the introduction of Postmaster cadre, suitable amendment may be made in Recruitment Rules of PS Group “B” cadre revising quota of General Line from 6% to 3%.
iv. Implementation of the recommendations of Second CRC and restructuring of Inspector, Posts cadre as an Inspector is getting promotion in P.S. Group “B” only after 24 to 26 years of service in Inspector, Posts cadre.
v. Revision of rates of remuneration for performing duty as Invigilators in the examinations.
vi. Supply of Laptops to all IPs/ASPs.
vii. Promotion earned through examination should be not be counted while granting MACP.
viii. 141 HSG I IP line posts may be re-designated as Assistant Superintendent Posts as it is a promotional for Inspector, Posts.
ix. Holding of periodical meetings with the Association at regular intervals. No periodical meeting has been held since long time despite submission of agenda for the same.
Charter of demands of our Association has been prepared on request from some Circle branches. All CHQ Office Bearers and Circle Secretaries are requested to go through it and submit their suggestions if any, through email/SMS/comments on the blog.

My Journey on the Chariot of Time is an Autobiography of a retired SSPOs who had started his career in the postal department in the year 1960. His eventful life as well as service has been a continuous struggle successfully waged against the evil forces obstructing his forward going and therefore it has the potential to inspire the new generation in all walks of life especially those who are now serving in the Department. The reader will come to know about him and his amazing book from the following lines. What the author has to say about his story?
“My story is not different from that of my contemporaries in the Department who had migrated like me, from the rustic villages but my story being my own reactions and reflections against adverse situations, has its own unique traits and hues. Here is the story of a man with humble origin, simple life, prudent actions, a string of tragedies, action stations and battles for justice and triumphant victory over the crooked- all ingredients of a melodrama in real life.”…It is not the obsessive rumination of a septuagenarian who believes that life is wheel-spin but it is a transmission of life experiences of one who believes that life is the wheel in eternity with the hope that it will make others lead a meaningful life with the wealth of truth, beauty and love planted in our hearts and minds by the Holy Spirit”…. “ It is a compendium of experiences, thoughts, ideas, faith, actions and hopes in life.”

It is an alliance of two minds longing to give a vent to the long suppressed feelings: it is merely a survival instinct for many who have no support system in life.”… “If all the administrative, operative and statutory functions of the Department of Post can be compressed in a human mould and it can be animated, we get INSPECTOR OF POST OFFICES.”…. “(I) climbed up the terrains: trudged through the ravines: traipsed along the stony-thorny paths: and forded the rivulets- all for reaching the inaccessible post offices-near the dreadful Chambal Ghat, infested with the menace of dacoits, where no Inspectors who loved life had visited for the last 25 years.”.…“In government service we have more tacticians and fewer practitioners.” … “ In his time, many a ‘stick in the mud’ with mud in the head was catapulted to hold lucrative posts in the circle and awards were conferred upon such people which earned ridicule from the staff in general.---But the fake performers got themselves palmed off on easy-going men in authority as the counterfeit coins are on unsuspecting customers.”….“If the superiors are weak, arrogant and haughty with the motive of self- aggrandizement, a string of sycophants and an all knowing man Friday come around them and worsen the situation by wielding the real power at the detriment of subordinate officers.”… “The poor are treated poorly and the rich richly! Respected Madam,
At the outset, we thank the Department for revising the pattern and syllabus of P.S. Group “B” examination. However, our Association would like to put the following points for clarification in the interest of members as well as the Department.
i) (a) In revised Paper I , it is not clear that whichc Acts / Departmental books should be consulted for preparation relating to Inland & Foreign Posts, Mail Operations, Money Remittances, Savings bank Schemes & Certificates, RPLI / PLI.
(b) It is also not clear which books/materials are to be consulted for preparation regarding Organization of Department, Office Procedure & Material management for optimum utilization of network, Establishment & Administrative matters.
ii) In respect of revised Paper II the syllabus is clear in respect of all items except “Accounts”. Normally accounts is covered under FRs & SRs and FHBs. In addition to FRs & SRs and FHBs, it is not understood why “ Accounts” has been mentioned separately.
iii) As per CCS (CCA) Rules 1965, an official placed under suspension is eligible to appear in Departmental examination. As such, condition as mentioned in the Directorate’s memo cited above that “No adverse entry in the APAR / ACR in the last five years” is contradictory to the instructions contained in CCS (CCA) Rules 1965.
iv) The number of vacancies identified for Sr. P.M. and PS Group" B” for the year 2011 has not been notified.
v) Since the revised pattern of the examination is new to the candidates, the Association requests the Department to circulate a model question paper in respect of Paper I & II of Sr. P.M. and PS Group “B” for the benefit of the officials.
It is therefore, requested to kindly issue necessary clarifications on the points mentioned above immediately before conduct of P.S. Group “B” examination scheduled to be held on 15.05.2011.

Result of Gr B Exam
As per the General Secretary's saying, the result of the PS Group B Exam which was held in May 2010, is likely to be announced by 15th February 2011.
Four Monthly Meeting with Chief PMG
The four monthly meeting of our association office bearers with the Chief PMG has been scheduled to have on 11-02-2011. The agenda for the meeting is as below:
